Buying items in France that are not suitable for the climate

Getting a refund might just have got easier. Has common sense gone out the window, I think so.


Snow Collapses Swimming Pool Enclosure


When a glazed swimming pool enclosure collapsed under the weight of snow the owners sought damages from the manufacturer.

Snow falls can be quite frequent in Marlhes, a small town located in the department of Loire (Auvergne-Rhône-Alpes), and with a limited summer season it is not surprising that some owners decide to install an enclosure over their pool.

However, when a heavy winter snowfall caused the glazed roof on one enclosure to collapse from the weight of the snow the owners decided to bring action for damages against the supplier.

In papers presented to the court, all sides agreed that the enclosure complied with relevant French technical standards, that it showed no manufacturing defect, and that it had been installed on-site in a proper manner, points confirmed by the court appointed expert witness.

It was also accepted that the owners had been supplied with a manufacturer’s notice that explicitly mentioned the need to clear the roof of snow.

When the case was heard in the court of appeal, the judges ruled that despite the difficulties that might be faced by the owner to clear the roof of snow, and that snowfalls in the area could be frequent and heavy, it did not make the enclosure unsuitable.

However, the owners appealed the decision to the Cour de Cassation, who quashed the decision, ruling that the owners were owed a duty of care by the supplier to ensure that the pool enclosure was suitable for their circumstances, notably for the weather conditions in the area.

They considered that the seller had an obligation to inquire about the needs of his client and to inform him about the suitability of the proposed enclosure for the intended use. The fact that they did not do so made them liable for damages to their client.

Mysty, do you have a link to the original French ruling or reporting on the case as it looks to have been rewritten rather than translated, often in doing so a completely different slant can be given by the author.

1°) ALORS QUE, tenu d'une obligation de conseil et d'information à l'égard de son client, le vendeur professionnel a l'obligation de se renseigner sur les besoins de celui-ci, afin d'être en mesure de l'informer quant à l'adéquation de la chose proposée à l'utilisation qui en est prévue ; qu'il ne satisfait pas à cette obligation de conseil et d'information en se bornant à remettre à l'acquéreur une notice d'utilisation présentant les règles techniques d'installation du produit et mettant en garde l'acquéreur sur la méconnaissance de ces dernières ; qu'en décidant néanmoins que la Société PISCINES PASSION et la Société CONFORT SÉCURITÉ PISCINE avaient exécuté leur obligation de conseil et d'information à l'égard de Monsieur X..., quant aux risques présentés par un défaut de déneigement du toit de l'abri jardin, par la fourniture d'une notice mentionnant explicitement la nécessité de déneiger, la Cour d'appel a violé l'article 1147 du code civillegifrance, dans sa rédaction antérieure à l'ordonnance n° 2016-131 du 10 février 2016 ;

2°) ALORS QUE, tenu d'une obligation de conseil et d'information à l'égard de son client, le vendeur professionnel a l'obligation de se renseigner sur les besoins de celui-ci, afin d'être en mesure de l'informer quant à l'adéquation de la chose proposée à l'utilisation qui en est prévue ; qu'en s'abstenant de rechercher, comme elle y était invitée, si la Société PISCINES PASSION et la Société CONFORT SÉCURITÉ PISCINE avaient informé Monsieur X... de l'inadaptation du modèle d'abri piscine proposé, en raison des fortes précipitations neigeuses, la Cour d'appel a privé sa décision de base légale au regard de l'article 1147 du code civillegifrance, dans sa rédaction antérieure à l'ordonnance n° 2016-131 du 10 février 2016 ;

3°) ALORS QUE, tenu d'une obligation de conseil et d'information à l'égard de son client, le vendeur professionnel a l'obligation de se renseigner sur les besoins de celui-ci, afin d'être en mesure de l'informer quant à l'adéquation de la chose proposée à l'utilisation qui en est prévue ; qu'en se bornant à relever que Monsieur X... avait été informé, par la remise de la notice, de la nécessité de déneiger le toit de l'abri piscine, sans constater qu'il aurait été informé du risque d'effondrement lié à une absence de déneigement, la Cour d'appel a privé sa décision de base légale au regard de l'article 1147 du code civillegifrance, dans sa rédaction antérieure à l'ordonnance n° 2016-131 du 10 février 2016 ;

4°) ALORS QUE, l'attestation de conformité à la norme NF P 90-309 en date du 11 avril 2006 mentionnait la conformité du modèle d'abri piscine «PRESTIGE » à ladite norme ; qu'en affirmant néanmoins que « l'attestation de conformité à cette norme en date du 11 avril 2006 concern[ait] le modèle AZUR » la Cour d'appel a dénaturé les termes clairs et précis de cette attestation, en violation de l'article 1134 du code civillegifrance, dans sa rédaction antérieure à l'ordonnance n° 2016-131 du 10 février 2016 ;

5°) ALORS QU'en s'abstenant de répondre aux conclusions de Monsieur X..., qui soutenait que la Société CONFORT SÉCURITÉ PISCINE devait l'indemniser sur le fondement de la garantie contractuelle du fabricant, la Cour d'appel a violé l'article 455 du Code de procédure civile.

2 °) ALORS THAN, having an obligation of advice and information with regard to his client, the professional salesman has the obligation to inquire on the needs of this one, in order to be able to inform him as to the suitability of the proposed thing for the intended use; that by refraining from seeking, as it was invited, if the Company PISCINES PASSION and the company COMFORT SECURITY SWIMMING POOL had informed Mr X ... of the unsuitability of the model of shelter swimming pool proposed, because of the heavy precipitations snow, the Court of Appeal has deprived its decision of legal basis under Article 1147 of the law civillegifrance, in its wording prior to the order n ° 2016-131 of February 10, 2016;

3 °) ALORS THAN, having an obligation of advice and information with regard to his client, the professional salesman has the obligation to inquire on the needs of this one, in order to be able to inform him as to the suitability of the proposed thing for the intended use; that by merely pointing out that Mr. X ... had been informed, by the delivery of the notice, the need to clear the roof of the pool shelter, without finding that he would have been informed of the risk of collapse linked to a lack of snow removal, the Court of Appeal deprived its decision of legal basis with regard to Article 1147 of the law civillegifrance, in its wording prior to the order n ° 2016-131 of February 10, 2016;

4 °) ALORS THAN, the attestation of conformity with the standard NF P 90-309 dated April 11, 2006 mentioned the conformity of the model of swimming pool shelter "PRESTIGE" with this norm; that affirming nonetheless that "the attestation of conformity with this norm dated April 11, 2006 concerns [the] AZUR model" the Court of Appeal distorted the clear and precise terms of this attestation, in violation of the article 1134 of the code civillegifrance, in its drafting prior to the order n ° 2016-131 of February 10, 2016;

5 °) ALORS THAN abstaining from answering the conclusions of Mr. X ..., who maintained that the company COMFORT SECURITY SWIMMING POOL was to compensate it on the basis of the contractual warranty of the manufacturer, the Court of Appeal violated Article 455 of the Code of Civil Procedure.

Erm........noooooooo (AtS whispered), still reads like stuff and nonsense, if the customer was told he would need to keep snow off it then he should have kept the snow off it or paid more and built a proper indoor swimming pool IMHO.
In the parallel universe inhabited by Brexiteers rationality and logic are increasingly inverted if not outright subverted.
