Consumer rights

Can someone explain consumer rights in France please, our two month old dishwasher has broken down and I would like it replaced nor repaired.

Every thing here has a two year guarantee, well almost. so take it back to where you purchased it, I've always done that with things gone wrong, no problem.

There appears to be no absolute right to have a faulty machine replaced rather than repaired.

You have the right to choose replacement and not accept a repair, good luck with that in practice, as has been said you dont have a chance in hell.

Just to get it repaired and working reliably within any time span would be a result, me I always take the thing apart and repair it myself, its just not worth the grief I am depressed to say, at any time I am already fighting on too many fronts.

Pour les biens achetés après le 18 Mars 2016, tous les défauts de conformité apparaissant pendant les 2 ans suivant l’achat, à l’exception des biens d’occasion dont le délai sera maintenu à 6 mois, sont présumés exister. Cette présomption opère un renversement de la charge de la preuve au bénéfice du consommateur ; c’est au professionnel de prouver que le défaut n’existait pas.
Exceptions

Le consommateur ne peut pas faire jouer la garantie de conformité selon l’article L.217-8 dans trois cas :

lorsqu’il avait connaissance du défaut au moment de contracter ;
lorsqu’il ne pouvait ignorer le défaut au moment de contracter ;
lorsque le défaut résulte de matériaux qu’il a lui-même fournis.

Mise en œuvre de la garantie de conformité

Lorsqu’il y a défaut de conformité, le professionnel propose au consommateur le remplacement du bien ou sa réparation. Le choix dépend du consommateur, sauf lorsque celui-ci engendre pour le professionnel des coûts disproportionnés par rapport a second moyen.

Consumer rights are like so many things in France, great on paper but not in practice. Sometimes you get lucky but it is rarely done with good grace. So it depends where you bought it and what mood they are in on the day.

Bought a computer from Carrefour, broke down within the week
took it back, they took it in and kept it for l month (no replacement , they
don't do that) went in week after week , they hated me, I hated them
after 1 month they gave me a credit note, I went ballistic and got my
money back, so stressfull I've never bought a machine from them again!

:( Same thing happened to me; same store but with a special offer cheap Chinese TV. Had to go away for repair as they said they had none left. The crunch time was four weeks because if it couldn't be repaired by then they had to give a refund. I complained bitterly when the refund turned out to be a credit note. The manager said they should have proposed a loan TV but they hadn't. On that basis they did offer a good discount an equivalent LG TV as a geste commercial so it didn't work out too badly in the end but, like Halfpint, it left a bitter taste.

If you have protection juridique insurance with your house insurance it might be worth a call to their number.
